General User Terms and Conditions for STC Online Auction
1. STC Online Auction is organized by Schoukens Training Center BV with registered office at Pollepelstraat 7B, B – 9990 Maldegem.
The General Terms and Conditions for the User are applicable to the relationship between the Buyers / Users on the one hand and Schoukens Training Center BV on the other for the use of the Website. In addition, the Privacy Statement of Schoukens Training Center BV as shown on its Website applies. The User / Buyer is supposed to review the latest amendments of the terms and conditions and the terms of the Privacy Statement when visiting the Website. Schoukens Training Center BV reserves the right to amend these General Terms and Conditions for the User / Buyer at all times.
Schoukens Training Center BV enters the Personal Details acquired by it into administrative records kept for that purpose. Through Registration on the Website, the User gives permission for the use and filing of the Personal Details registered.
2. Participation in this auction implies that Buyer / User acknowledges and accepts the explicit auction conditions.
3. Schoukens Training Center BV sells horses or goods and products via its website on its own behalf as well as for account of third parties. Schoukens Training Center BV acts as auction service. The auction committee acts as mediator between seller and buyer.
4. Buyers / Users as from the age of majority must register themselves via the website www.stc-auction.com to be allowed to participate in the STC Online Auction . The User’s Agreement arises through Registration on the Website. The User’s Agreement cannot be transferred to another party. In the Registration the User provides his personal details to Schoukens Training Center BV and chooses his own password for access to the Website.
Schoukens Training Center BV confirms the Registration by email to the User at the email address submitted by the latter, after which the User has access to the Auction by means of his password.
The User is obligated, after gaining access to the Website, to behave decently and not to damage the Website or other users of the Website. The User is liable for all actions that occur on the Website after he has gained access by means of the User’s password
The User guarantees the accuracy and completeness of the Personal Details supplied during Registration. Should the Personal Details change at any time, the User is obligated to inform Schoukens Training Center BV of this change.
Through a (one-time) Registration, the User accepts the General Terms and Conditions as well as the Terms of the Privacy Statement & Policy for the User for every time that the User logs on the Website, regardless of whether he makes any bids. Schoukens Training Center BV reserves the right to refuse and/or terminate the right to Registration unilaterally.
The buyer/User shall upon first request of Schoukens Training Center BV submit a copy of his identity documents.
Where there is doubt regarding the Buyers / Users identity and/or solvency, Schoukens Training Center BV shall always be entitled to exclude any Buyers / Users.
Schoukens Training Center BV strives, in accordance with the requirements of reasonableness, to secure its systems against loss of Personal Details and/or against any form of unlawful use and implements the appropriate technical and organizational measures, whereby account is taken of the status of the technology, the costs of implementation and purposes of processing.
However, Schoukens Training Center BV is not liable for loss of data, damage to files, unlawful access to computers or files, viruses spread via the Website or other unlawful programs or files or any other consequence of the use that is made of the Website.
The Website can contain links to other websites. Schoukens Training Center BV has no authority over such sites and is not liable for the content of those sites.
The User is forbidden to duplicate the Website or any part thereof or to make it available (via deep links or in any other way) without prior written permission from Schoukens Training Center BV.
5. The sale is realized under Belgian law by means of bidding and allotment to the highest bidder after payment of the settlement amount.
All lots shall be attributed to the highest bidder who is identifiable and has been accepted as reliable and solvent. If any dispute arise between the bidders, Schoukens Training Center BV shall decide without motivating its decision. This decision may not be appealed. The highest bidder shall have the obligation to pay the price of the attributed lot.
6. The Lot(s) will be auctioned in the condition they have at the time of the auction.
There is no warranty As to the soundness, merchantability or fitness for any particular purpose of any horse(s) offered in this Auction.
Mares described as being In Foal will have a breeding certificate and a statement on written from confirmed pregnancy with the date of examination, however NO Life Foal Guarantee is granted.
All Lot(s) are sold to their present condition at auction with all their defects, visible and/or hidden. The Buyers/Users shall be deemed to have inspected the lots thoroughly.
All Lot(s) are sold “AS IS” and ALL SALES ARE FINAL.
7. Bids and payments are to be made in EURO. The auction will proceed according to certain bidding steps that can vary different per lot.
8. The website will state an indicative closing time of the auction per specific lot. If, however, a bid is made in the last 5 minutes before the closing time of a lot, the auction time for that specific lot will be automatically extended by 5 minutes. The extended time will become the new indicative closing time.
Some lot(s) can have a “Buy Now” option, meaning the lot(s) can be sold immediately for a fixed and displayed price to the buyer.
9. Schoukens Training Center BV reserves the right to withdraw a Lot at any time, to cancel an Auction, to terminate an Auction earlier than reported on the Website or to extend one for any plausible reason.
Schoukens Training Center BV is entitled to combine goods in one lot, to divide a lot and / or remove a lot from the auction.
In case of a technical malfunction of the Website, causing it to be not completely accessible and/or inaccessible to Users, Schoukens Training Center BV has the right to extend the Auction by 24 hours.
10. The Lot(s) in the auction will be sold to the highest bidder. Before placing a bid permanently, a control screen on which the full purchase price appears shall be displayed. Upon its confirmation, the bid shall be irrevocable and unconditionally binding.
Upon completion of the auction, the result shall be presented to the client. The settlement of the sales price by buyer is calculated as follows: the allotment price including sales commission and any VAT possibly due, which constitutes the total settlement amount. By making a bid, the bidder undertakes to pay the settlement amount, unless a higher bid is made thereafter.
11. Successful bidders must tender the full purchase price ( the settlement amount) upon allotment (= Immediately) by Wire Transfer only.
Following the sale an invoice or bill of sale will be sent to the buyer.
After its expiry date, the procedure of default sale shall be initiated automatically and without prior notice. If the Buyer/User is in default, Schoukens Training Center BV shall be authorized to move, store and/or resell the lot at the expense and risk of the Buyer/User. The Buyer/User shall be held liable, vis-à-vis Schoukens Training Center BV as well as any client, for any negative damage allegedly caused by his failure, including relocation and storage costs.
In case the Buyer/User refuses to pay or is not solvent, Schoukens Training Center BV or a judicial officer may proceed to immediate recovery, re-put the lot up for auction, or attribute the lot to the second highest bidder. The buyer in default shall be held responsible for the damages suffered and shall never be able to claim for the possible higher price. All costs incurred for re-putting the unpaid lot up for auction or the price difference between the initial bid and the second highest bid shall be borne by the Buyer/User who failed to meet his obligations in time.
The VAT amount ( when applicable) will be reimbursed to the buyer who:
possess a European Union VAT registration number and will confirm the intra-community delivery of the collected lot(s)
or
will submit exportation documents, confirming exportation of the purchased lot(s) out of the territory of The European Union, under the condition, that the customs export procedure was started in the territory of The European Union and will be completed within 6 month from the date of making full payment for the purchased lot(s).
12. At allotment to the final bidder, the buyer assumes all risk and responsibility for the lot(s). However in the case of Horses, Immediate full mortality insurance coverage is effective upon the allotment, for the amount of the total purchase price. The insurance, arranged by the Auction management (SCHOUKENS TRAINING CENTER BV) with C. Jarvis Insurance Agency of Solon, Ohio will remain in effect until midnight of the first business day after the sale, by which time it is the obligation of the new owner to arrange permanent insurance if desired. Both Seller and Auction Committee ( SCHOUKENS TRAINING CENTER BV) encourages to EXTEND the full mortality insurance coverage with C. Jarvis Insurance Agency of Solon, Ohio. Any and All liability ( accidents, theft, disease, sickness, death, injury or damage to any horse, whatsoever caused) regarding the auctioned Lot(s) will be waived from SCHOUKENS TRAINING CENTER BV, Seller, Owners, officers, members, agents, riders, grooms or representatives.
After auctioning AND payment, buyer and seller will make arrangements for the delivery in mutual consultation.
13. Prospective buyers are encouraged to do their own due diligence prior to the auction and obtain an opinion of a veterinarian of their choosing. In such instances, the prospective buyer must make arrangements in advance with Schoukens Training Center BV in order to conduct the examination at their own expenses and to PREPAY for such exam.
Buyers/Users are given the opportunity to visit the lot(s) if they wish so. Any visible and hidden defects shall always be considered to be known by the Buyers/ Users. Any claims by the Buyer/User, due to (non-) compliance or other reasons shall expressly be excluded.
The Buyer/User has sufficiently verified the condition of the purchased goods and has accepted its condition at the moment he placed his bid. The Buyer/User shall therefore not be entitled to terminate the agreement if it appears that the lot does not (entirely) meet the online lot description.
The Seller nor SCHOUKENS TRAINING CENTER BV will not respond to claims formulated on the basis of hidden defects which it could not have been in a position to be aware of at the time the sale was concluded. Both seller and SCHOUKENS TRAINING CENTER BV shall undertake the duty to have listed all available veterinary information, and all known information concerning the horse.
14. The information provided about the lot(s) is exclusively intended to give an impression of the qualities of the lot(s), without pretending to be complete and without offering any guarantees. For the description of a lot in its online catalogue, Schoukens Training Center BV is purely led by the information about that lot provided by the seller or a third party. Schoukens Training Center BV is not liable for any printing mistakes and/or material errors on its website and online catalogue.
15. The lot(s) will be collected from the Seller at the expense of the Buyer. Delivery will only take place after SCHOUKENS TRAINING CENTER BV has informed the Seller that the settlement amount, as defined in article 11 of these auction conditions, has been deposited into the account number of SCHOUKENS TRAINING CENTER BV. Upon Full Payment, lot(s) will be released and titles will be transferred. The seller or SCHOUKENS TRAINING CENTER BV is allowed to charge expenses such as Boarding fees, Veterinary fees, Farrier fees, etc. for the lot(s), as from the allotment.
16. In case SCHOUKENS TRAINING CENTER BV is liable, its liability shall be limited to what is provided in this Article as SCHOUKENS TRAINING CENTER BV acts mainly as intermediary and thus not always as owner of the goods.
SCHOUKENS TRAINING CENTER BV shall not be held liable for indirect or consequential damages or any other damages of any kind. Nor shall SCHOUKENS TRAINING CENTER BV be held liable for specific damages such as (including but not limited to) loss of information, loss of profits, damages resulting from business interruption or any other pecuniary damages.
SCHOUKENS TRAINING CENTER BV shall not be held responsible for missing or incomplete documents, including registration certificates, covering certificates, conformity certificates, etc…
SCHOUKENS TRAINING CENTER BV shall secure its website as much as possible. SCHOUKENS TRAINING CENTER BV cannot be held liable for damages resulting from any virus, bug, or program or application incompatible with the infrastructure adopted by the user as well as from circumstances which are beyond the control of SCHOUKENS TRAINING CENTER BV or any other damage resulting from the use of the website.
Collecting the lot(s) shall be done at buyer’s risk. SCHOUKENS TRAINING CENTER BV shall never be held liable for any (physical) damage caused to the buyer or third parties upon collection of the goods.
The Buyer/User shall remove the purchased goods professionally at his expense and risk. The liability upon removal is borne entirely by the buyer. The buyer shall also be responsible for his assistants, employees or appointed persons upon removal of the goods
SCHOUKENS TRAINING CENTER BV shall not be held liable for damages caused by environmentally damaging or noxious substances in or on the purchased goods.
The Buyer/User shall be responsible for verifying the accuracy of the information sent by email during the online and/or live auction. SCHOUKENS TRAINING CENTER BV shall therefore not be held responsible by the Buyer/User for technical mistakes or omissions in the information sent by email during the online and/or live auction.
Each Buyer/User, in the capacity of legal and natural person, shall be deemed to have bought for himself and in his own name and for which he is jointly and severally responsible. Each buyer remains liable for his purchase, even if someone else is designated as buyer. The buyer remains personally liable for payment of the lots attributed to him and this, in whatever capacity he might be acting.
SCHOUKENS TRAINING CENTER BV shall not be held liable for damages caused in the context of an online auction due to computer malfunctions, any interruptions of any kind, included but not limited to defects and/or malfunctions of hardware and/or software, other technical problems, overload, etc. SCHOUKENS TRAINING CENTER BV shall therefore not be held liable for damages caused if the (candidate) Buyer/User due to a computer malfunction is not able to place a bid. In such a case, SCHOUKENS TRAINING CENTER BV shall decide whether to attribute the lots or to re-put them up for auction.
Except in the case of gross fault and intent on the part of SCHOUKENS TRAINING CENTER BV, Schoukens Training Center BV shall never be held liable for any damage as listed in these Terms and Conditions.
The aforementioned circumstances shall never lead to any financial compensation to the Liability
If any provision of these TERMS and CONDITIONS is held to be illegal or invalid, such illegality or invalidity shall not affect the remaining provisions of these TERMS and CONDITIONS, and they shall be continued and enforced as if such illegal or invalid provision had never been inserted herein.
17. In the event of a dispute only the Dutch text will prevail. The translation of these auction conditions into another language is purely informatory.
18. Any dispute arising from this auction and its consequences will be exclusively ruled by Belgian law with exclusion of the provisions of the Vienna Sales Treaty regarding international purchases/sales. Both The Court of Commerce and the Court in first instance of Oost-Vlaanderen, Gent department are exclusively competent to take cognizance of any disputes.

1.STC Online Auction wordt georganiseerd door Schoukens Training Center BV met maatschappelijke zetel te Pollepelstraat 7B, B – 9990 Maldegem.
De Algemene Voorwaarden voor de Gebruiker zijn van toepassing op de relatie tussen de Kopers / Gebruikers enerzijds en Schoukens Training Center BV anderzijds voor het gebruik van de Website. Daarnaast is de privacyverklaring van Schoukens Training Center BV zoals weergegeven op haar website van toepassing. De gebruiker / koper wordt geacht de laatste wijzigingen van de algemene voorwaarden alsook de voorwaarden van de privacyverklaring door te nemen wanneer hij de website bezoekt.
Schoukens Training Center BV behoudt zich het recht voor om deze algemene voorwaarden voor de gebruiker / koper ten allen tijde te wijzigen. Schoukens Training Center BV bewaart de door haar verkregen Persoonsgegevens in een voor dat doel bijgehouden administratie. Door registratie op de website geeft de gebruiker toestemming voor het gebruik en het indienen van de geregistreerde persoonlijke gegevens.
2. Deelname aan deze veiling houdt in dat Koper / Gebruiker de expliciete veilingvoorwaarden erkent en accepteert.
3. Schoukens Training Center BV verkoopt paarden of goederen en producten via haar website voor eigen rekening en voor rekening van derden. Schoukens Training Center BV treedt op als bemiddelaar tussen verkoper en koper.
4. Kopers / gebruikers moeten meerderjarig zijn bij het registreren en om via de website www.stc-auction.com te mogen deelnemen aan de STC Online Auction. De gebruikersovereenkomst komt tot stand door registratie op de website. De gebruikersovereenkomst kan niet worden overgedragen aan een andere partij. Bij de registratie verstrekt de gebruiker zijn persoonlijke gegevens aan Schoukens Training Center BV en kiest hij zijn eigen wachtwoord voor toegang tot de website.
De gebruiker is verplicht, na toegang te hebben gekregen tot de website, zich fatsoenlijk te gedragen en de website of andere gebruikers van de website niet te beschadigen. De Gebruiker is aansprakelijk voor alle handelingen die op de Website plaatsvinden nadat hij toegang heeft verkregen door middel van het wachtwoord van de Gebruiker.
Schoukens Training Center BV bevestigt de Registratie per e-mail aan de Gebruiker op het door deze opgegeven e-mailadres, waarna de Gebruiker met zijn wachtwoord toegang heeft tot de Veiling. De gebruiker garandeert de nauwkeurigheid en volledigheid van de persoonlijke gegevens die tijdens de registratie worden verstrekt. Indien de Persoonsgegevens op enig moment wijzigen, is de Gebruiker verplicht Schoukens Training Center BV op de hoogte te stellen van deze wijziging.
Door middel van een (eenmalige) registratie accepteert de gebruiker de algemene voorwaarden alsook de voorwaarden van de privacyverklaring voor elke keer dat de gebruiker inlogt op de website, ongeacht of hij een bod uitbrengt. Schoukens Training Center BV behoudt zich het recht voor om het recht op Registratie eenzijdig te weigeren en / of te beëindigen.
De Koper / Gebruiker legt op verzoek van Schoukens Training Center BV een kopie van zijn identiteitsbewijs voor.
Bij twijfel over de identiteit en / of solvabiliteit van Kopers / Gebruikers heeft Schoukens Training Center BV altijd het recht Kopers / Gebruikers uit te sluiten. Schoukens Training Center BV streeft ernaar, in overeenstemming met de redelijkheidseisen, haar systemen te beveiligen tegen verlies van Persoonsgegevens en / of tegen enige vorm van onrechtmatig gebruik en implementeert de passende technische en organisatorische maatregelen, waarbij rekening wordt gehouden met de status van de technologie, de kosten van implementatie en verwerkingsdoeleinden.
Schoukens Training Center BV is echter niet aansprakelijk voor verlies van gegevens, schade aan bestanden, onrechtmatige toegang tot computers of bestanden, via de Website verspreide virussen of andere onwettige programma’s of bestanden of enig ander gevolg van het gebruik dat van de Website wordt gemaakt. De website kan links bevatten naar andere websites. Schoukens Training Center BV heeft geen zeggenschap over dergelijke sites en is niet aansprakelijk voor de inhoud van die sites.
Het is Gebruiker niet toegestaan de Website of enig onderdeel daarvan te dupliceren of ter beschikking te stellen (via deep links of op enige andere wijze) zonder voorafgaande schriftelijke toestemming van Schoukens Training Center BV.
5. De verkoop wordt gerealiseerd naar Belgisch recht door middel van bieding en toewijzing aan de hoogste bieder na betaling van het afrekeningsbedrag.
Alle kavels worden toegewezen aan de hoogste bieder die identificeerbaar is en als betrouwbaar en solvabel is geaccepteerd. Indien er een geschil ontstaat tussen de bieders, beslist Schoukens Training Centre BV zonder motivering van haar beslissing. Tegen deze beslissing is geen beroep mogelijk. De hoogste bieder is verplicht de prijs van het toegekende lot te betalen.
6. De kavel (s) wordt (worden) geveild in de staat waarin ze zich op het moment van de veiling bevinden. Er is geen garantie met betrekking tot de gezondheid, deugdelijkheid, verkoopbaarheid of geschiktheid voor een bepaald doel van paarden die in deze veiling worden aangeboden. Merries die beschreven worden als drachtig hebben een dek certificaat en een schriftelijke verklaring van dracht met de datum van inseminatie. Er wordt in geen geval levend veulen garantie verleend.
Alle kavels worden op de veiling verkocht in de staat waarin ze zich bevinden met al hun gebreken, zichtbaar en / of verborgen. De kopers / gebruikers worden geacht de kavels grondig te hebben geïnspecteerd. Alle kavels worden verkocht “in de staat waarin ze zich bevinden” en ALLE VERKOPEN ZIJN DEFINITIEF.
7. Biedingen en betalingen dienen te geschieden in EURO. De veiling verloopt volgens bepaalde biedstappen die per kavel kunnen verschillen.
8. Op de website wordt per kavel een indicatieve sluitingstijd van de veiling vermeld. Indien echter in de laatste 5 minuten voor sluitingstijd van een kavel wordt geboden, wordt de veilingtijd voor dat specifieke kavel automatisch met 5 minuten verlengd. De verlengde tijd wordt de nieuwe indicatieve sluitingstijd.
Sommige kavels kunnen een “Nu kopen” -optie hebben, wat betekent dat de kavel (s) onmiddellijk kunnen worden verkocht voor een vaste en weergegeven prijs aan de koper.
9. Schoukens Training Center BV behoudt zich het recht voor om een Kavel op elk moment in te trekken, een Veiling te annuleren, een Veiling eerder dan op de Website vermeld te beëindigen of om een aannemelijke reden te verlengen.
Schoukens Training Center BV heeft het recht goederen in één kavel te combineren, een kavel te verdelen en / of een kavel te verwijderen uit de veiling. In geval van een technische storing van de Website, waardoor deze niet geheel toegankelijk en / of ontoegankelijk is voor Gebruikers, heeft Schoukens Training Center BV het recht de Veiling met 24 uur te verlengen.
10. De kavel (s) in de veiling worden verkocht aan de hoogste bieder.
Voordat een bod definitief wordt uitgebracht, wordt een controlescherm weergegeven waarop de volledige aankoopprijs wordt weergegeven. Na bevestiging is het bod onherroepelijk en onvoorwaardelijk bindend. Na afloop van de veiling wordt het resultaat aan de koper gepresenteerd. De verrekening van de verkoopprijs door de koper wordt als volgt berekend: de toewijzingsprijs is inclusief verkoopcommissie en eventueel verschuldigde btw, die het totale afrekeningsbedrag vormt.
11. Succesvolle bieders moeten de volledige aankoopprijs (het afrekeningsbedrag ) betalen bij toewijzing (= onmiddellijk) en dit enkel per bankoverschrijving.
Na de verkoop wordt er een factuur of verkoopbewijs naar de koper gestuurd.
Na de vervaldatum wordt de procedure voor standaardverkoop automatisch en zonder voorafgaande kennisgeving gestart. Indien Koper / Gebruiker in verzuim is, is Schoukens Training Center BV bevoegd de kavel te verplaatsen, op te slaan en / of door te verkopen voor rekening en risico van Koper / Gebruiker.
Koper / Gebruiker is jegens Schoukens Training Center BV en eventuele opdrachtgever aansprakelijk voor eventuele schade die door zijn nalatigheid zou zijn veroorzaakt, waaronder verplaatsing- en opslagkosten.
Indien de Koper / Gebruiker weigert te betalen of niet solvabel is, kan Schoukens Training Center BV of een gerechtsdeurwaarder overgaan tot onmiddellijke invordering, het kavel opnieuw ter veiling aanbieden of het kavel toeschrijven aan de op één na hoogste bieder. De in verzuim zijnde koper is verantwoordelijk voor de geleden schade en zal nimmer aanspraak kunnen maken op de eventueel hogere prijs. Alle kosten gemaakt voor het opnieuw aanbieden van het onbetaalde kavel of het prijsverschil tussen het initiële bod en het op één na hoogste bod komen voor rekening van de Koper / Gebruiker die niet tijdig aan zijn verplichtingen heeft voldaan.
Het btw-bedrag (indien van toepassing) wordt terugbetaald aan de kopers die:
• beschikken over een geldig BTW nummer van de Europese Unie en die de intracommunautaire levering van de kavel(s) wenst (en) of
• een uitvoerdocument voorleggen ter bevestiging van de uitvoer van de gekochte kavel(s) uit het grondgebied van de Europese Unie, op voorwaarde dat de douane-uitvoerprocedure is begonnen op het grondgebied van de Europese Unie en dit binnen 6 maanden na de datum van volledige betaling voor de gekochte kavel(s).
12. Bij toewijzing aan de uiteindelijke bieder neemt de koper alle risico en verantwoordelijkheid voor de kavel (s). Alhoewel, In het geval van paarden is een onmiddellijke en volledige overlijdensrisicoverzekering van kracht voor het bedrag van de totale aankoopprijs. De verzekering, geregeld door het veilingmanagement (SCHOUKENS TRAINING CENTER BV) bij C. Jarvis Insurance Agency uit Solon, Ohio, blijft van kracht tot middernacht op de eerste werkdag na de verkoop, op welk moment het de verplichting is van de nieuwe eigenaar desgewenst een permanente verzekering af te sluiten. Zowel de verkoper als het veilingcomité (SCHOUKENS TRAINING CENTER BV) moedigt aan om de volledige overlijdensrisicoverzekering uit te breiden met C. Jarvis Insurance Agency uit Solon, Ohio. Alle aanvraagformulieren zijn toegankelijk via de site https://www.jarvisinsurance.com/forms/livestock-mortality-application
Alle aansprakelijkheid (ongevallen, diefstal, ziekte, ziekte, dood, letsel of schade ) met betrekking tot de geveilde kavel (s) wordt kwijtgescholden van SCHOUKENS TRAINING CENTER BV, verkoper, eigenaren, officieren, leden, agenten , ruiters, grooms of vertegenwoordigers.
Na veiling EN betaling zullen koper en verkoper in onderling overleg de levering regelen.
13. Potentiële kopers worden aangemoedigd om voorafgaand aan de veiling in hun eigen gepaste zorgvuldigheid onderzoek te doen en of advies in te winnen bij een dierenarts naar keuze. In dergelijke gevallen dient de aspirant-koper vooraf met Schoukens Training Center BV afspraken te maken om het onderzoek op eigen kosten te laten plaatsvinden en VOORAF te betalen voor een eventueel dergelijk onderzoek.
Kopers / gebruikers krijgen de mogelijkheid om de kavel (s) te bezoeken als ze dat willen. Alle zichtbare en verborgen gebreken worden altijd geacht bekend te zijn bij de kopers / gebruikers. Eventuele aanspraken van Koper / Gebruiker wegens (niet-) nakoming hiervan zijn uitdrukkelijk uitgesloten.
De koper / gebruiker heeft de staat van de gekochte goederen voldoende geverifieerd en heeft deze op het moment van zijn bod aanvaard. Koper / Gebruiker heeft dan ook niet het recht de overeenkomst te ontbinden indien blijkt dat het kavel niet (geheel) voldoet aan de online kavelomschrijving. De verkoper noch SCHOUKENS TRAINING CENTER BV zullen niet reageren op claims die zijn geformuleerd op basis van verborgen gebreken waarvan zij niet op de hoogte kon zijn op het moment dat de verkoop werd gesloten. Zowel de verkoper als SCHOUKENS TRAINING CENTER BV verbinden zich ertoe alle beschikbare veterinaire informatie en alle bekende informatie over het paard te hebben vermeld in eer en geweten.
14. De verstrekte informatie over de kavel (s) is uitsluitend bedoeld om een indruk te geven van de kwaliteiten van de kavel (s), zonder zich voor te doen als volledig en zonder enige garantie te bieden. Voor de beschrijving van een kavel in haar online catalogus wordt Schoukens Training Center BV louter geleid door de informatie over dat kavel verstrekt door de verkoper of een derde partij. Schoukens Training Center BV is niet aansprakelijk voor drukfouten en / of materiële fouten op haar website en online catalogus.
15. De kavel (s) wordt / worden op kosten van de koper bij de verkoper opgehaald. Levering vindt pas plaats nadat SCHOUKENS TRAINING CENTER BV de Verkoper heeft medegedeeld dat het afrekeningsbedrag, zoals omschreven in artikel 11 van deze veilingvoorwaarden, is gestort op het rekeningnummer van SCHOUKENS TRAINING CENTER BV. Bij volledige betaling worden de kavels vrijgegeven en worden de titels overgedragen. De verkoper of SCHOUKENS TRAINING CENTER BV mag vanaf de toewijzing kosten zoals: Stalgeld, veterinaire kosten, hoefsmid kosten, enz. in rekening brengen voor de kavel (s).
16. Indien SCHOUKENS TRAINING CENTER BV aansprakelijk is, is haar aansprakelijkheid beperkt tot hetgeen in dit artikel is bepaald aangezien SCHOUKENS TRAINING CENTER BV voornamelijk optreedt als tussenpersoon en dus niet altijd als eigenaar van de goederen.
SCHOUKENS TRAINING CENTER BV is niet aansprakelijk voor indirecte of gevolgschade of enige andere schade van welke aard dan ook. SCHOUKENS TRAINING CENTER BV is evenmin aansprakelijk voor specifieke schade zoals (inclusief maar niet beperkt tot) verlies van informatie, winstderving, schade als gevolg van bedrijfsstagnatie of enige andere financiële schade.
SCHOUKENS TRAINING CENTER BV kan niet verantwoordelijk worden gehouden voor ontbrekende of onvolledige documenten, inclusief registratiecertificaten, dekcertificaten, conformiteitscertificaten, enz. …
SCHOUKENS TRAINING CENTER BV zal haar website zoveel mogelijk trachten te beveiligen.
SCHOUKENS TRAINING CENTER BV kan niet aansprakelijk worden gesteld voor schade die het gevolg is van een virus, bug, programma of applicatie die niet compatibel is met de door de gebruiker gekozen infrastructuur, of van omstandigheden die buiten de controle van SCHOUKENS TRAINING CENTER BV liggen of enige andere schade als gevolg van het gebruik van de website.
Het afhalen van de kavel(s) geschiedt op risico van de koper. SCHOUKENS TRAINING CENTER BV is nimmer aansprakelijk voor enige (fysieke) schade die bij het afhalen van de kavel(s) aan de koper of derden wordt toegebracht.
De Koper / Gebruiker zal de gekochte zaken voor zijn rekening en op eigen risico vakkundig afhalen. De aansprakelijkheid bij afhaling is geheel voor rekening van de koper. De koper is ook verantwoordelijk voor zijn assistenten, werknemers of aangestelde personen bij het afhalen van de kavel(s).
SCHOUKENS TRAINING CENTER BV is niet aansprakelijk voor schade veroorzaakt door milieubelastende of schadelijke stoffen in of op de gekochte goederen.
De Koper / Gebruiker is verantwoordelijk voor het verifiëren van de juistheid van de informatie die per e-mail wordt verzonden tijdens de online en / of live veiling. SCHOUKENS TRAINING CENTER BV kan daarom niet verantwoordelijk worden gehouden door de Koper / Gebruiker voor technische fouten of weglatingen in de informatie die per e-mail wordt verzonden tijdens de online en / of live veiling.
Elke Koper / Gebruiker wordt, in de hoedanigheid van rechtspersoon en natuurlijk persoon, geacht voor zichzelf en in eigen naam te hebben gekocht en waarvoor hij hoofdelijk aansprakelijk is. Elke koper blijft aansprakelijk voor zijn aankoop, ook als iemand anders als koper is aangewezen. De koper blijft persoonlijk aansprakelijk voor betaling van de hem toegekende kavel(s) en dit, in welke hoedanigheid hij ook handelt.
SCHOUKENS TRAINING CENTER BV kan niet aansprakelijk worden gesteld voor schade veroorzaakt in het kader van een online veiling als gevolg van computerstoringen, onderbrekingen van welke aard dan ook, inclusief maar niet beperkt tot defecten en / of storingen van hardware en / of software, andere technische problemen , overbelasting, etc. SCHOUKENS TRAINING CENTER BV is dan ook niet aansprakelijk voor schade ontstaan indien de (kandidaat) Koper / Gebruiker door een computerstoring niet in staat is een bod uit te brengen. In dat geval beslist SCHOUKENS TRAINING CENTER BV of de kavels worden toegewezen of dat ze opnieuw worden geveild.
Behalve in geval van grove schuld en opzet van SCHOUKENS TRAINING CENTRE BV, is Schoukens Training Center BV nimmer aansprakelijk voor enige schade als genoemd in deze Algemene Voorwaarden.
Bovenstaande omstandigheden leiden nimmer tot enige financiële vergoeding van de Aansprakelijkheid.
Als een bepaling van deze Algemene Voorwaarden onwettig of ongeldig wordt geacht, heeft deze onwettigheid of ongeldigheid geen invloed op de overige bepalingen van deze VOORWAARDEN en deze worden voortgezet en gehandhaafd alsof een dergelijke onwettige of ongeldige bepaling nooit was opgenomen hierin.
17. Bij betwisting geldt uitsluitend de Nederlandse tekst. De vertaling van deze veilingvoorwaarden in een andere taal dan het Nederlands is louter informatief.
18. Alle geschillen die voortvloeien uit deze veiling en de gevolgen ervan worden exclusief beheerst door de Belgische wet, met uitsluiting van de bepalingen van het Weens Koopverdrag met betrekking tot internationale aankopen / verkopen. Zowel de rechtbank van koophandel als de rechtbank in eerste aanleg van Oost-Vlaanderen, afdeling Gent zijn bij uitsluiting bevoegd kennis te nemen van eventuele geschillen.
